Article 407 of the Criminal Code of Ukraine: Unauthorized Abandonment of a Military Unit in 2026

What Article 407 of the Criminal Code provides for

Article 407 of the Criminal Code of Ukraine establishes liability for unauthorized abandonment of a military unit or place of service for a period of more than 24 hours without valid reasons. Depending on the number of aggravating circumstances, the punishment varies:

  • up to 3 years of restriction of liberty;
  • up to 7 years of imprisonment;
  • up to 10 years in case of a repeat offense or during combat operations.

  • servicemen who did not return from leave.

How to avoid or mitigate liability under Article 407

The law allows the consideration of circumstances that exclude criminal liability or mitigate it:

  • voluntary return;
  • medical reasons;
  • family circumstances;
  • wrongful mobilization;
  • violations on the part of the command.
