Checks before you buy: 5 steps

Order an extract from the State Register of Property Rights: who the owner is, whether there are freezes, mortgages or prohibitions. That is the minimum before any money changes hands.

Check the history of ownership transfers. Frequent resales over a short period are a classic sign of a problem property.

Verify the seller: documents, marital status and the spouse consent, children rights, court cases and debts in the registers.

In a new build, check the developer: the land documents, the construction permit, the reputation and the state of its previous projects.

Do not hand over a deposit without a written contract setting out clear terms for its return. A receipt scribbled on the spot will not protect your money.

QUESTIONS AND ANSWERS

Frequently asked questions about property

At minimum: an extract from the property rights register (owner, freezes, mortgages), the history of ownership transfers, the seller identity and the spouse consent, any debts attached to the property, and for a new build the developer land and construction documents. Best of all, have a lawyer look at the documents before any money changes hands.

The notary checks the formalities as at the moment of the deal, but does not analyse the property history, the risk of the deal being challenged, or whether the contract terms serve you. A lawyer works for you: finding the reasons the deal could be challenged and removing them before signing.

First we record the delay and send a claim letter. After that, depending on the contract: a penalty, termination with your money returned, or establishing title through the court. The earlier you start, the better the chance of getting the money back while the developer is still solvent.

The route depends on the building and on the land documents: the construction amnesty, permit procedures, or the court. First we analyse what has been built and on what land, then we choose a route to legalisation that will actually work.

Yes, through the court: where the rights of co-owners or children were breached, documents were forged, the seller had no right to sell, or the deal was a sham. Limitation periods are short, so it is not worth waiting.

At first instance, usually from a few months to a year or more, depending on complexity and expert reports. Some disputes can be closed by settlement much faster. We give a more precise estimate after reviewing the documents.

Examples of property cases

Situation: the client was buying a flat on the resale market and was about to hand over the deposit.

Actions: we checked the registers and the history of the property, found a freezing order and an undischarged mortgage, and stopped the payment.

Result: the encumbrances were removed and the deal went through safely. The client lost neither the deposit nor the flat.

Situation: the building should have been handed over two years earlier; the developer kept pushing the dates back and feeding the client promises.
